| Abstract
| - Door de evolutietheorie van Lamarck ingegeven, stelt Bonfante tegen het einde van de XIXde eeuw een origineel beeld voor van de oorspronkelijke romeinse familie en van haar ontwikkeling door 13 eeuwen heen. Die hypothese reikt verder dan een loutere beschrijving van de familiestruktuur en beoogt de ontwikkeling van talrijke instellingen te verklaren. Hedentendage is het standpunt van Bonfante nog voor vele befaamde romanisten bekoorlijk. Nochtans trekken de huidige onderzoekers uit de direkte ontleding van de bronnen van het ius familiae konklusies die de fundamenten van Bonfantes konstruktie doen wankelen. Het onderzoek van die soms tussengeworpen, impliciete of versnipperde tegenwerpingen poogt van de Romeinse familie een beeld op te hangen dat met de beschikbare bronnen overeenstemt.
- Towards the end of the 19th century P. Bonfante, inspired by the evolutionistic theories of Lamarck, proposed an original image of the "initia" of the archaic Roman family and of its evolution during 13 centuries. His assumption, which was anxious to provide through the family structure the development of many private law institutions with a unitary and explanatory frame, appeals even today to a large number of romanists. Yet from the direct study of the sources of family law current research draws conclusions that unsettle the essential foundations of P. Bonfante’s theory. We have devoted ourselves to the investigation of these direct and indirect objections in an attempt to restore an image of the Roman family more consistent with the data of the sources that are currently available.

Bonfante, inspiré par les théories évolutionnistes de Lamarck, a proposé une image originale des "initia" de la famille romaine archaïque et de son évolution pendant 13 siècles. Cette hypothèse qui, par-delà la structure familiale, se souciait de fournir un cadre explicatif unitaire au développement de nombreuses institutions du droit privé, séduit, aujourd’hui encore, un grand nombre de romanistes réputés. Pourtant, la recherche actuelle tire de l’examen direct des sources du droit familial, des conclusions qui ébranlent les fondements essentiels de la construction de P. Bonfante. C’est à un examen de ces objections, émises de façon parfois incidente, implicite ou dispersée que nous nous sommes livrés pour tenter de restituer par contrecoup une image de la famille romaine plus conforme au donné des sources dont nous disposons actuellement.
